Research In Motion, maker of the once ubiquitous BlackBerry, just released its Q4 2012 earnings. They're not good. Revenue dropped to $4.2 billion, down 19% from the third quarter. Likewise, BlackBerry sales plummeted 21% from Q3 down to 11.1M units, but surprising, PlayBook sales were way up to 500k units. One of the company's former co-CEO's Jim Balsillie resigned amid what we're hearing are deep layoffs throughout the company. This is the first set of financial data released under the new CEO, Thorsten Heins. Even though there are black clouds looming over Waterloo, as my headline states, it's time to believe in RIM again. The conditions are right for a rebirth.

Following on from Jo Parry's piece about her work being copied, I had a look in the archives and found this piece from issue 1 of Computer Arts on the same subject. Funnily enough it mentions a case from 1994 where a photo library sued Corel over a CG image that clearly drew extensively on a library photo. I did a bit of reading up on it, and found the case cited in online discussions about Shepard Fairey's 'Hope' image, which itself fell foul of an IP infringement claim. Plus ?a change and all that...

Copy and be damned

Image stealing is big business in the digital age. New technologies mean that old notions of copyright have become redundant ? or at the very least, unenforceable

Everyone does it but they don't like to talk about it. Should you meet someone who says they never do it then you know they're a liar. We aren't talking self abuse here, that's legal, we're talking copyright abuse ? stealing other people's creative work and passing it off as your own. You must have done it. Scanned a magazine image, copied one, downloaded one from a Net newsgroup or perhaps you slipped in that photo library image a second time? No one is going to notice after all- are they?

Chances are they won't unless it's a well known image. Copyright law is close to being unenforceable ? or as arbitrarily enforced-- as the laws on cannabis. The police do not hunt down those who trade in stolen images, no boys in blue stake out design houses and if you report a copyright infringement to the police nothing will happen. You have to defend your copyright personally ? and win or lose you're likely to come out poorer and angrier than when you went in.

The concept of copyright is as simple as its enforcement is impossible. It protects the expression of an author's original work ? where original is used in the sense of origin ? not new. This definition is important. Copyright doesn't protect an idea, just its execution. You have no copyright until you express an idea in some concrete form.

The form can be a painting, drawing, photograph, electronic file or smears of blood on car panels ? if it's an original work then you automatically own the copyright. The standards for originality are extremely low ? copyright applies to the drivel you sent your first love and the snaps you took of the resulting children on holiday.

It's all yours. No one can use ten per cent of your image, or five per cent. The law is clear on this. if it's recognisably your work ? in whatever form or however altered ? your copyright has been infringed. You can demand recompense and if you don't get it you can go to court, internationally. Copy right law effectively dates from the Berne Convention of 1886. The Universal Copyright Convention was written in Geneva in 1952 and heavily revised in 1971. Out of interest, you have fewer rights and countries have fewer duties to authors, under the UCC than under Berne. Not all countries, even now, recognise copyright or subscribe to the Berne conventions, though.

Oddly, when the US became signatories to the updated Berne Convention in 1989. UCC became less important. The full texts, requirements, duties and consequences of copyright law as embodied in the Berne Convention fill tomes, so we aren't going to print it all here.

National law modifies Berne, though it must add rights rather than subtract them. However, what the books on copyright law are bloated with is precedent. Copyright is messy and, with new technologies, harder than ever to define and defend.

For example, if you design and program an interactive 3D digital world for sale, is it subject to copyright as the expression of an idea or patent law as a machine? Who knows, it hasn't been decided. Software is subject to copyright but some software patents have been granted in the US. Computers have blurred the boundary between art and artifact.

OK, so you believe that your copyright has been infringed, now what? Well, if you do go to court you have first to demonstrate the originality of your work. This is where you should plan on losing a chunk of your life, your savings and future earnings along with your belief in justice. There is little new under the sun. Where are the Dadaists now, eh?

Most creative work grows out of other creative work. Ideas seek freedom, they fly from mind to mind where they change and mutate. Am I stealing your work or paying you the compliment of using your ideas? One is legal the other not.

Bully Will Open Unrated

In an attempt to get around the MPAA?s nearsighted ?R? rating for Lee Hirsch and Alicia Dwyer?s award-winning documentary, Bully, The Weinstein Company has announced that they will release the film as Unrated. Bully, which investigates the prevalence of bullying in our nation?s schools, was hit with an ?R? rating after an appeal by TWC came up one vote shy, regardless of a petition signed by nearly 500,000 individuals who felt that the rating would limit kids? ability to see the film.

The reason for the rating? A few instances of foul language, something that occurs in hallways and school buses on a daily basis. By restricting the film to kids who would need a parent or guardian present to attend, the MPAA has become the bully themselves. Unfortunately, many theaters won?t show unrated films, which now precludes both the children and their parents from being able to see the film at all. At least Gerry Lopez, CEO of AMC theaters, has taken a stand in support of the film, saying that his theaters will show it regardless of the unrated status. The Weinstein Company has announced that ?Bully,? the award-winning documentary about the epidemic of school bullying in the United States, will open in theaters on March 30 as ?unrated? after nearly 500,000 people signed an extraordinarily popular online petition at Change.org demanding that the Motion Picture Association of America (MPAA) remove the ?R? rating initially given to the movie by the MPAA?s ratings board.

?I am happy ?Bully? will maintain its authenticity and will be an accurate portrayal of what thousands of kids experience every day,? said Katy Butler, a bullied high school student from Michigan who was outraged that the MPAA gave ?Bully? an ?R? rating by just one vote because of brief language. Butler, who had her finger broken by bullies in middle school, urged the MPAA to remove the ?R? rating from ?Bully? so that middle school and high school students would have a chance to see a movie that could potentially save their lives.

?The MPAA might not recognize the reality that thousands of bullied kids face each day in school, but nearly 500,000 people around the country, from celebrities to politicians to bullied kids themselves, stepped up to speak out about bullying by signing my petition,? said Butler. ?The brief use of explicit language in this film reflects what so many kids hear each day in school when they?re being bullied. The MPAA said they wouldn?t drop the ?R? rating unless this language was removed, but nothing can remove it from the halls and playgrounds of schools where bullied students hear it each day, except education and exposure.?

Lee Hirsch, director of ?Bully,? said that the ?unrated? designation for the film will allow the film to portray the real trauma and torment that bullied students experience each day in school.

?The small amount of language in the film that?s responsible for the ?R? rating is there because it?s real. It?s what the children who are victims of bullying face on most days,? Hirsch said in a statement put out by The Weinstein Company announcing the ?unrated? designation. ?All of our supporters see that, and we?re grateful for the support we?ve received across the board. I know the kids will come, so it?s up to the theaters to let them in.?

Gerry Lopez, the CEO of AMC Theaters, one of the largest movie theater chains in the world, signed Katy Butler?s Change.org petition. ?He said previously in a statement that he will make sure ?Bully? plays at AMC Theaters even with an ?unrated? rating.

?AMC will show this movie, and we invite our guests to engage in the dialogue its relevant message will inevitably provoke,? Lopez said.

Lopez is just one of several high profile individuals who signed Butler?s campaign on Change.org. Ellen DeGeneres signed the petition, inviting Butler to appear on her show and urging her viewers to support the petition, and Anderson Cooper, Kelly Ripa, Justin Bieber, Johnny Depp, Meryl Streep, Michael Jordan, Demi Lovato, Randy Jackson, and Drew Brees all encouraged their fans to show support to ?Bully,? objecting to the ?R? rating it received.

UNIVERSITY OF ROCHESTER ECONOMIST: Rush Limbaugh Is Right, Sandra Fluke Is A 'Prostitute'

It has been one week since Rush Limbaugh first called Georgetown University law student Sandra Fluke a "slut" and a "prostitute," but the controversy shows no sign of dying down.

Now University of Rochester economist and former Slate blogger Steven Landsburg has jumped to Limbaugh's defense.

In a blog post, Landsburg argued that while the talk radio host's language may have been off-color, Limbaugh's logic was analytically shrewd. Fluke, Landsburg writes, "deserves only to be ridiculed, mocked, and jeered" for saying that women should have access to contraception."

He adds that Limbaugh's demand that Fluke and other Georgetown students post online sex tapes in exchange for contraception was actually a "spot-on analogy":

"If I can reasonably be required to pay for someone else?s sex life (absent any argument about externalities or other market failures), then I can reasonably demand to share in the benefits. His dense and humorless critics notwithstanding, I am 99% sure that Rush doesn?t actually advocate mandatory on-line sex videos. What he advocates is logical consistency and an appreciation for ethical symmetry. So do I. Color me jealous for not having thought of this analogy myself."

Unsurprisingly, Landsburg's arguments sparked a mini-firestorm at the University of Rochester, prompting the school's president to issue a public dissent. Landsburg has resoundingly dismissed his critics as "contraceptive sponges," and devoted another blog posts to rebutting their arguments in favor of contraception access.

But Landsburg's focus on the economic benefits and drawbacks of contraception have little to do with Fluke and her congressional testimony. Fluke was not, as Limbaugh and Landsburg have suggested, "demanding" that taxpayers pay for her to have sex; her testimony was originally part of a debate about whether religious institutions should be required to provide access to contraception. Her argument focused primarily on the medical (and non-contraceptive) uses of birth control.

Sandra Fluke?s appearances on-camera thus far, as well as Rush Limbaugh?s well publicized reaction to her Congressional testimony, turned her into a martyr for the Left. But now there are not only holes in her story but she has been connected to White House advisor and former Commincations Director Anita Dunn as well as to leftist Soros sponsored media group, Media Matters.

Bill O'Reilly investigates to find out who is really behind the Sandra Fluke controversy. 'The Factor' discovers the Georgetown law student is being represented by an organization where Anita Dunn, the former Obama communications director, is the managing editor. He Bill O?Reilly told viewers in a segment with Laura Ingraham that he strongly believes that the White House is ?running? Sandra Fluke and has been behind her from the beginning.

And then over the weekend, O?Reilly?s team uncovers that Sandra Fluke?s boyfriend is son of ?Democratic stalwart William Mutterperl?? My, my, my!

It has become more and more evident that the appearance of Sandra Fluke is no fluke but rather has turned out to be a straw woman for Team Obama and the Progressive left?? She is? connected to Media Matters and the White House and is a professional activist for contraception, abortion and even taxpayer funds for sex change operations. While she is described as a ?third year law student? they always conveniently fail to mention that she is also the past president of Law Students for Reproductive Justice.

Fluke is really 30-years-old (not the 23 that has been reported), and specifically went to Georgetown to fight their contraception policy ? far from the innocent, wide-eyed victim she?s tried to portray herself to be. And Fluke?s testimony for Congress, included precisely zero references to recreational sex or to abortion. Instead, Fluke would have her audience believe she?s only interested in non-sexual reasons for needing contraceptive pills ? such as treating ovarian cancer. According to one study, the number of people to whom this applies is about 14 percent of all contraceptive users.

But is this really all Fluke?s agenda is? Based on the affiliations she herself has cited, that question may be more complicated. Near the beginning of her testimony, Fluke said the following (emphasis added):

My name is Sandra Fluke, and I?m a third year student at Georgetown Law, a Jesuit school. I?m also a past president of Georgetown Law Students for Reproductive Justice or LSRJ. I?d like to acknowledge my fellow LSRJ members and allies and all of the student activists with us and thank them for being here today.

So if Fluke has these sorts of ties to an organization and mentions them by name for the purposes of appreciation, readers will probably assume she supports their agenda.

Now there seems to be increasing speculation that Sandra Fluke might be a great grandchild of Fabian/Progressive Founder of Planned Parenthood and the Negro Project whose beliefs are rooted in eugenics.? The speculation began when someone noticed how much Sanger and Fluke look alike.

SANGER, KATHRYN ISABELL FLUKE May 13, 1910 to Sept. 12, 2010 Kathryn died restfully in her sleep in the early morning hours of September 12, 2010. She was one of six children born to Carrie and Loren Fluke on the Kansas Prairie. She moved to San Diego in 1940, where she worked during the War at Convair. She retired from civil service after 20 years. Moved to Valley Center after the passing of her husband, Clarence (Bud) Sanger in 1975. She is preceded in death by son, Jimmy McClish. She is survived by son Gary McClish and daughter Barbara Blind, her brother Loren Fluke, and devoted niece Betty Jacobs; there are eight grandchildren, 10 great-grandchildren and eight great-great-grandchildren, and too many nephews, nieces and stepchildren to count. She was the most caring and loving person and always put the needs of others over her own. She will truly be missed by not only her family, but all those who knew her. Her passion was gardening; her love was deep for her roses, humming birds, and Padres baseball. A Viewing will be on Friday, September 17, 2010, from 5 to 9 p.m., with a Service on Saturday, September 18th, at 11 a.m. at Greenwood Memorial Park. Following the services on Saturday, a celebration of her life will be held at Bayview Molibe Home Park Clubhouse at 2003 Bayview Heights Drive.

World Bank must mirror global shift: Okonjo-Iweala

WASHINGTON (Reuters) - Emerging economies must be given a fair shot at leading the institutions at the heart of global finance or they will end up going their own way, a challenger for the top job at the World Bank.

"The balance of power in the world has shifted and emerging market countries are contributing more and more to global growth - more than 50 percent - and they need to be given a voice in running things," Nigerian Finance Minister Ngozi Okonjo-Iweala told Reuters in an interview released on Monday. "If you don't, they will lose interest."

Okonjo-Iweala, 57, was nominated on Friday by African powerhouses Nigeria, South Africa and Angola to lead the poverty-fighting institution when its current president Robert Zoellick steps down in June.

Also nominated for the post are Jim Yong Kim, a Korean-American health expert whose name was put forward by U.S. President Barack Obama on Friday, and former Colombian finance minister Jose Antonio Ocampo, who was nominated by Brazil.

It is also the first time the post has ever been so hotly contested.

Under an informal agreement between the United States and its allies in Europe, Washington has laid claim to the top post at the World Bank since its founding after World War Two, while a European has always led the International Monetary Fund, its sister Bretton Woods institution.

Okonjo-Iweala said fast-growing emerging economies were becoming too powerful and influential in the world economy to continue denying them the leadership posts at global financial bodies.

Leaders of the so-called BRICS nations China, India, Brazil, Russia and South Africa will meet at a summit in India next week to discuss the world economy and closer coordination.

"I'm telling you, the BRICS are already talking about forming a bank among themselves to deal with infrastructure," she said. "Why do you think they're doing it? If they can't get a leg in to be allowed to run some of these institutions, they will look elsewhere."

A respected economist and diplomat, Okonjo-Iweala painted the nominating convention as a vestige of a bygone era.

"We're not asking the U.S. not to compete, we're just asking for a level playing field where candidates can be evaluated on their merits. America can join the competition," she said.

A former World Bank managing director known for her colorful African head wraps and dresses, Okonjo-Iweala contrasted her experience with that of Kim, who made his mark fighting disease in some of the poorest corners of the world.

She noted that she has hands-on experience running one of Africa's largest economies, as well as a proven track record at the World Bank helping nations in Asia, Africa and the Middle East to tap financial markets and fund development.

"I don't have a learning curve because I know how the institution works and I know what needs to be done to make it work better and faster for developing countries," she said.

U.S. Treasury Secretary Timothy Geithner told Reuters over the weekend that he was confident that Kim, president of Dartmouth College, would win global support for the job. Okonjo-Iweala acknowledged that if the United States - the country with the largest World Bank voting bloc - and Europe held together, her candidacy would be doomed. But she expressed hope the World Bank's 187 members would hold true to their pledge for an open, merit-based process.

"We are not just going into this saying to ourselves we are already defeated," she said, speaking by telephone from Abuja. "We are hoping that the Bretton Woods institutions and their shareholders will keep their word."

"My biggest hope is that this will be a fair contest."

Okonjo-Iweala, who was named by Forbes magazine last year as one of the world's 100 most powerful women, said African leaders would be discussing her nomination with other developing and emerging economies including China, the World Bank's third-largest shareholder.

Her political situation in Nigeria is a difficult one. She left the World Bank last year to become the lead economic architect in Nigerian President Goodluck Jonathan's cabinet.

A long-time anti-corruption campaigner, she immediately sought to implement politically tough reforms. One of her first moves was to remove fuel subsidies, a step that sparked widespread protests forcing the government to back down in January.

Now her opponents are attacking her over the World Bank nomination, saying it showed disloyalty to her country and its president. Jonathan backed Okonjo-Iweala's nomination after calls from South African President Jacob Zuma and West African countries led by Ivory Coast's President Alassane Outtara, himself a former IMF deputy managing director.

"Several African leaders called my president and asked for my name to be put forward because they felt they have someone really qualified to do this job," she said, adding that she remains deeply committed to Nigeria.

Last year, Okonjo-Iweala was behind a World Bank plan to create so-called diaspora bonds to raise money from the estimated 23 million Africans living abroad, who hold more than $30 billion in savings. The money would be used to help African countries fund essential services and fight poverty.

She was also instrumental in launching an emergency fund to for poor countries hit by a record jump in global food prices in 2008, and was pivotal in creating an infrastructure facility for roads, railways and power grids in developing countries.

In Nigeria, she secured a deal with the Paris Club of creditor nations in 2005 that wiped out $30 billion in the country's debt, in the second-largest Paris Club debt relief deal ever.

Okonjo-Iweala said a critical issue for many developing countries is job creation, especially among unemployed youth. High unemployment, corruption and political oppression sparked the "Arab Spring" protests that toppled leaders in such countries as Egypt, Tunisia, Libya and Yemen, she noted.

"If we do not come to terms with this problem, we're not going to have (just) the Arab Spring, we will have many other Springs," she said. "This is a very important challenge that demands us to go beyond the usual poverty eradication and fighting tools to ask ourselves what is needed."

While the World Bank's main mission is to fight poverty, it has increasingly sought ways to help emerging economies that need policy expertise more than money, and Okonjo-Iweala said it had to become more nimble in this task.

"Emerging market countries ... need the bank to be a provider and intermediator of knowledge from one country to another," she said. "To do that we need to organize the experts from the bank in a much smarter and faster fashion."

"When you are a policymaker and you have a question facing you, you don't have three weeks to wait for a (World Bank) mission to arrive."

Geologists discover new class of landform -- on Mars

ScienceDaily (Mar. 22, 2012) ? An odd, previously unseen landform could provide a window into the geological history of Mars, according to new research by University of Washington geologists.

They call the structures periodic bedrock ridges. The ridges look like sand dunes but, rather than being made from material piled up by the wind, the scientists say the ridges actually form from wind erosion of bedrock.

"These bedforms look for all the world like sand dunes but they are carved into hard rock by wind," said David Montgomery, a UW professor of Earth and space sciences. It is something there are not many analogs for on Earth."

He believes the ridges, while still bedrock, are composed of a softer, more erodible material than typical bedrock and were formed by an unusual form of wind erosion that occurs perpendicular to the prevailing wind rather than in the same direction.

He contrasts the ridges with another bedrock form called a yardang, which has been carved over time by headwinds. A yardang has a wide, blunt leading edge in the face of the wind, and its sides are tapered so that it resembles a teardrop.

In the case of periodic bedrock ridges, Montgomery believes high surface winds on Mars are deflected into the air by a land formation, and they erode the bedrock in the area where they settle back to the surface.

Spacing between ridges depends on how long it takes for the winds to come back to the surface, and that is determined by the strength of the wind, the size of the deflection and the density of the atmosphere, he said.

The discovery is important because if the ridges were actually created by wind depositing material into dunes, "you're not going to have information from any prior history of the material that is exposed at the surface," he said.

"But if it's cut into instead, and you're looking at the residual of a rock that has been eroded away, you can still get the history of what was happening long ago from that spot," Montgomery said.

"You could actually go back and look at some earlier eras in Martian history, and the wind would have done us the favor of exposing the layers that would have that history within it," he said. "There are some areas of the Martian surface, potentially large areas, that up until now we've thought you couldn't really get very far back into Mars history geologically."

Montgomery is the lead author of a paper documenting the discovery published online March 9 in the Journal of Geophysical Research, a journal of the American Geophysical Union. Coauthors are Joshua Bandfield, a UW research assistant professor of Earth and space sciences, and Scott Becker, who did the work as an undergraduate in Earth and space sciences and has received his degree. The work was funded in part by NASA.

There could be landforms on Earth that are somewhat similar to periodic bedrock ridges, Montgomery said, but to date there's nothing exactly like it, largely because there are not many bedrock landscapes on Earth in which wind is the main erosion agent.

"There are very few places ? where you have bedrock exposed at the surface where there isn't also water that is carving valleys, that's shaping the topography," he said. "Mars is a different planet, obviously, and the biggest difference is the lack of fluvial action, the lack of water working on the surface."

When it comes to fitness, few people have inspired more local women to get moving and be proud of their bodies than Rosa Martinez. Rosa is known around town as the ?Queen of Zumba,? having taught the fun and exciting fitness class all over the Fresno/Clovis area since it began in 2001.

As one of the early adopters of Zumba fitness, Rosa has adapted and transformed Zumba and truly made it her own. Her choreography and music is absolutely infectious and her classes truly make you feel like you are at a party, not working out. Rosa?s own journey to health and fitness has inspired many, but that?s not all ? she?s also an inspirational entrepreneur, having followed her dreams of opening her own studio, Rosa?s Studio. Read on as we ask Rosa about her sources of inspiration and her life as both a business owner and fitness instructor.

The Full Moxie: What inspired you to open Rosa?s Studio?
RM: Ever since I was young, I had a dream to open my own studio. I?ve always loved to dance so that vision was always part of me. Little did I know life would lead me to open a dance and fitness studio instead. My inspiration? Women! And how dance and fitness can change a woman?s mood, and even how she views herself.

Where do you find inspiration in general? ?
I started in the dance/fitness movement when Zumba came along (2001) and I was teaching in many gyms around town. That lead me to meet many women and hear their experiences and testimonials about my classes and what they felt I brought to them and their day. That in itself keeps me motivated and it inspires me to keep touching as many lives as possible.

Clearly you have moxie. Where does that come from?
God! I had a less than perfect childhood ? went through very hard times in my teenage years. But no matter what, God was always there to keep me focused and to remind me I can do all things that I set out to do! God gave me a passion ? it?s the type of passion that moves me even if I?m sick, or in pain.

What are your hopes for Rosa?s Studio in the coming years?
I see it growing threefold. I see Rosa?s Studio being a platform for women to not only be inspired but learn to inspire others. I would love to open more studios and offer the opportunity to other dreamers like me to reach their potential and goals.

How do you find the energy to both run a business and teach multiple classes a day?
(laughing) Good question! I always ask myself the same question. I guess the easiest way to put it is, I tend to put myself in situations in which I either have to sink or swim. I know me well enough to know sinking isn?t an option. So, I don?t think it is about energy, more about determination.

What type of music inspires you the most when it comes to envisioning new choreography?
Latin beats have always been my roots but, for some reason, Caribbean music moves me from the core.

What?s the best part of your week?
When I have a FULL class and when I see my participants letting loose. When they come tell me how sexy they feel. When they refer others because they can?t wait to share the excitement with them. When they tell me I?m their favorite instructor LOL!

Any advice you have for someone who?s never tried Zumba before?
